The Closed Circle of State Power"},"content":{"rendered":"<p><strong>They say we need agencies to monitor the market. But no one seems to ask: who monitors the agencies?<\/strong><\/p>\n\n\n\n<p>In this post, we will expose how the so-called \u201cindependent authorities\u201d of the State \u2014 such as regulatory agencies and technical bodies \u2014 often become <strong>instruments of political power<\/strong>, captured by interest groups and disconnected from any real control by society.<\/p>\n\n\n\n<p>\ud83d\udc49 Read also: <a class=\"\" href=\"https:\/\/poderemercado.com.br\/en\/\">Perpetual Emergency: How the State Uses Crises to Expand<\/a><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The myth of regulatory neutrality<\/strong><\/h2>\n\n\n\n<p>Regulatory agencies emerged with the promise of protecting consumers, ensuring fair competition, and preventing abuses.<br>In theory, they are \u201ctechnical\u201d, \u201cindependent\u201d bodies that act as impartial arbitrators between the State, the market and society.<\/p>\n\n\n\n<p>In practice, however, these institutions often:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>They act under the direct influence of the government in power<\/strong><\/li>\n\n\n\n<li><strong>They protect large companies from competition with excessive rules<\/strong><\/li>\n\n\n\n<li><strong>They become a political springboard or a job opportunity for allies<\/strong><\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Regulator or gatekeeper?<\/strong><\/h2>\n\n\n\n<p>The problem is not regulating the basics \u2014 but transforming the regulator into <strong>absolute lord of entire sectors<\/strong> of the economy.<\/p>\n\n\n\n<p>Who controls an agency like ANVISA, ANEEL, ANATEL or CADE:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Defines who can operate.<\/li>\n\n\n\n<li>Decide what can be sold.<\/li>\n\n\n\n<li>Set the rules of the game \u2014 and change them whenever you want.<\/li>\n<\/ul>\n\n\n\n<p>And this creates a paradox: the greater the power of the regulator, the less freedom the regulated agents have.<br>The market ceases to be an open field and becomes a closed club \u2014 with rules created by <strong>who doesn&#039;t play, but chooses who enters.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Regulatory capture is real<\/strong><\/h2>\n\n\n\n<p>The term &quot;<strong>regulatory capture<\/strong>\u201d describes this phenomenon exactly:<br>An agency that should protect society <strong>begins to serve the interests of the companies closest to power<\/strong>.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Banks that influence Central Bank regulations.<\/li>\n\n\n\n<li>Health plans that operate under the shadow of the ANS.<\/li>\n\n\n\n<li>Large energy companies that shape ANEEL\u2019s performance.<\/li>\n\n\n\n<li>Logistics monopolies protected by ANTT decisions.<\/li>\n<\/ul>\n\n\n\n<p><strong>Regulation becomes a privilege. Competition becomes an exception.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Invisible Cost of Overpowered Bureaucracy<\/strong><\/h2>\n\n\n\n<p>The more power given to the regulator, the more unpredictable the business environment becomes.<br>And this generates:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Less innovation<\/li>\n\n\n\n<li>Less investment<\/li>\n\n\n\n<li>Less entry of new competitors<\/li>\n\n\n\n<li>More bureaucracy<\/li>\n\n\n\n<li>More costs passed on to the consumer<\/li>\n<\/ul>\n\n\n\n<p>The result? A state system where <strong>no one is elected, but everyone commands.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>And who regulates the regulator?<\/strong><\/h2>\n\n\n\n<p>This is the question that almost no one asks.<\/p>\n\n\n\n<p>If the market makes a mistake, it is punished by competition, by bankruptcy, by the consumer.<br>But when does an agency make a mistake?<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who answers?<\/li>\n\n\n\n<li>Who pays?<\/li>\n\n\n\n<li>Who fires the \u201cexpert\u201d who paralyzed entire sectors out of caution, ideology or convenience?<\/li>\n<\/ul>\n\n\n\n<p><strong>There is no vote. There is no market.
